The specific scope, deliverables, timelines, and fees for professional services engagements are governed by separate written Statement of Work ("SOW") or Service Agreement documents executed between BSK SFR and the Client. In the event of any conflict between these Terms and a fully executed SOW or Service Agreement, the SOW or Service Agreement shall control with respect to the subject matter therein.
3. Site Use and Acceptable Use Policy
3.1 Permitted Use
You may access and use the Site for lawful purposes and in accordance with these Terms. The Site is intended for informational purposes and to facilitate inquiries about our professional services.
3.2 Prohibited Activities
You agree not to:

If you provide suggestions, ideas, or feedback regarding our Site or services ("Feedback"), you grant BSK SFR a non-exclusive, royalty-free, perpetual, irrevocable license to use, incorporate, and exploit such Feedback without restriction or compensation to you.
5. Confidentiality
Information disclosed by either party in connection with a services engagement that is designated as confidential or that a reasonable person would understand to be confidential given the circumstances of disclosure shall be treated as confidential by the receiving party. Specific confidentiality obligations are governed by the applicable Service Agreement or Non-Disclosure Agreement between the parties.

6.1 Site Content
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BSK SFR DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6.2 Professional Services
BSK SFR warrants that its professional services will be performed in a competent and professional manner consistent with industry standards. Specific service warranties are set forth in the applicable SOW or Service Agreement. EXCEPT AS EXPRESSLY SET FORTH IN A SERVICE AGREEMENT, ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT SHALL BSK SFR, LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- BSK SFR'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
- FOR PROFESSIONAL SERVICES ENGAGEMENTS, TOTAL LIABILITY IS GOVERNED BY THE APPLICABLE SERVICE AGREEMENT, BUT IN NO EVENT SHALL EXCEED THE FEES PAID BY CLIENT IN THE THREE (3) MONTHS PRECEDING THE CLAIM, UNLESS OTHERWISE AGREED IN WRITING.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.
8. Indemnification
You agree to indemnify, defend, and hold harmless BSK SFR, LLC, its members, managers, officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your infringement of any third-party intellectual property or other right; or (d) any misrepresentation made by you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO BRING CLAIMS AGAINST BSK SFR AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

- Entire Agreement: These Terms, together with the Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and BSK SFR with respect to the Site and supersede all prior communications and proposals.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
